Notary Public vs Commissioner of Oaths

Many people confuse these two roles. Understanding the difference will ensure you make an appointment with the right person for your legal document.

Notary Public

A notary public is an official appointed by the government to help ensure the proper execution of legal documents such as:

  • Deeds and contracts
  • Affidavits and certifications
  • International transactions
  • Special Power of Attorney
  • True copies of original documents

Notaries verify identification, confirm understanding of the document, and ensure signing is voluntary. Their signature and seal are registered in a public registry.

Commissioner of Oaths

A commissioner of oaths is entitled to take affidavits and administer oaths, declarations, and affirmations under the Commissioners for Taking Affidavits Act.

Key Limitations:

  • Cannot verify true copies of documents (unless also a notary)
  • Stamp valid only in their certified province
  • May have authority limitations on their stamp

Lawyer and paralegal licensees in Ontario are deemed commissioners of oaths by virtue of their office.
