What is EJS?

An Extrajudicial Settlement of Estate is a legal process under Philippine law (Rule 74 of the Rules of Court) that allows heirs to divide the estate of a deceased person among themselves through a notarized agreement — without filing a court case.

When Is It Needed?

When a Filipino relative passes away and leaves property (land, house, bank accounts) in the Philippines, the title cannot be transferred to heirs without an EJS. This is true even if you are the sole heir or all heirs agree.
