LEGAL INFORMATION
Divorce in Ontario
The federal Divorce Act governs divorce procedures in Ontario. Either spouse can apply if they meet the legal requirements.
Key Point: You must be separated for at least one year before a divorce can be granted. This is the most common ground for divorce in Canada.

🇵🇭 For Filipinos: The Philippines does not recognize divorce. However, a Canadian divorce is legally valid in Canada. If you need to remarry in the Philippines, you may need to have your Canadian divorce recognized through a Philippine court process.

Family Law in Ontario is governed by both federal and provincial legislation. The federal Divorce Act dictates procedures for divorce, while the provincial Family Law Act and Children’s Law Reform Act handle matters such as child custody, spousal support, and property division.
On what grounds can one apply for a divorce in Ontario?
A spouse can apply for a divorce in Ontario on the grounds of a one-year separation, adultery, or mental or physical cruelty. The one-year separation is by far the most common ground used.
Can I get a divorce in Canada if I was married in the Philippines?
Yes. Canadian courts have jurisdiction to grant divorces regardless of where the marriage took place, as long as you meet residency requirements (one spouse must have lived in the province for at least one year).
How much does a family lawyer in Toronto charge?
Family lawyer fees in Toronto vary widely. Uncontested divorces typically cost $1,500-$3,000 as a flat fee. Contested matters are usually billed hourly, ranging from $300-$500+ per hour. At JCA Law Office, we offer transparent pricing with flat-rate packages for straightforward matters.
How long does a divorce take in Ontario?
An uncontested (joint or simple) divorce typically takes 4-6 months from filing to receiving the divorce certificate. Contested divorces can take 12-24+ months depending on the complexity of the issues and court schedules. The mandatory one-year separation period must also be completed before the divorce is granted.
Do I need a lawyer for an uncontested divorce in Ontario?
While it’s possible to file for an uncontested divorce without a lawyer, we strongly recommend having legal representation to ensure all paperwork is correct and your rights are protected. Mistakes can cause delays and additional costs. A lawyer can also ensure any separation agreement properly addresses custody, support, and property division.
Can my spouse and I use the same divorce lawyer?
No. Due to conflict of interest rules, one lawyer cannot represent both spouses. However, in an uncontested divorce, often only one spouse retains a lawyer while the other reviews and signs the documents independently (or with their own independent legal advice). We recommend each party at least consults with their own lawyer before signing any agreement.
What is the difference between separation and divorce?
Separation is when spouses stop living together as a married couple – it doesn’t require any legal paperwork. Divorce is the legal termination of the marriage through a court order. You must be separated for at least one year before you can get a divorce in Canada. You can formalize separation with a Separation Agreement that addresses custody, support, and property division.
