OUR #1 PHILIPPINE SERVICE
Extrajudicial Settlement of Estate (EJS)
The most efficient way to settle a Philippine estate among heirs — without going to court
What is EJS?
An Extrajudicial Settlement of Estate is a legal process under Philippine law (Rule 74 of the Rules of Court) that allows heirs to divide the estate of a deceased person among themselves through a notarized agreement — without filing a court case.
When Is It Needed?
When a Filipino relative passes away and leaves property (land, house, bank accounts) in the Philippines, the title cannot be transferred to heirs without an EJS. This is true even if you are the sole heir or all heirs agree.
Why Choose JCA?
We handle the entire process from Canada: drafting the EJS deed, coordinating with Philippine counsel, managing BIR estate tax filing, publication requirements, and title transfer — so you never need to fly back.
The EJS Process (Simplified)
1
Gather Documents
Death certificate, titles, tax declarations, IDs of all heirs
2
Draft EJS Deed
Agreement signed by all heirs detailing the division of estate
3
File Estate Tax
Submit estate tax return to BIR and pay applicable taxes
4
Publish & Register
Publish in newspaper, register with Registry of Deeds, transfer title
